Justin Timberlake, a pop singer, will appear in court on Long Island next week after his lawyer filed a motion to dismiss his DWI case.

While the “Cry Me a River” singer was playing in Poland, his lawyer submitted a motion to dismiss the prosecution, claiming that the criminal charge was flawed.

According to attorney Edward Burke, the paperwork from Timberlake’s arrest was signed by a part-time police officer rather than a sergeant, as is normal.

The Long Island DA claims that they ratified the mistake and then filed the right documentation.

Burke requested that Timberlake be rescheduled, and the judge granted the motion. He also requested that he present in person or electronically, considering Timberlake’s European performance schedule.

Burke says Timberlake will appear virtually next Friday, August 2, for the rescheduling. Timberlake’s attorney argues that he was not intoxicated and is optimistic that the charges will be dropped.

According to court paperwork acquired by FOX 5 NY’s Jodi Goldberg, Timberlake ran a stop sign and failed to maintain to the right side of the road while driving early on June 18.

Justin Timberlake was arrested on Long Island and accused with driving under the influence, according to sources and police records. His mug shot was released later Tuesday.

Timberlake’s SUV is seen speeding down a Sag Harbor street in video from Hamptons.com, soon before his arrest.

He was stopped by a police near Madison Street and Germain Avenue in Sag Harbor, a small community roughly 100 miles east of New York City, while driving a 2025 BMW UT with Florida plates.

Prior to his arrest, he was pulled over after being observed by cops, but it took some time for law enforcement to ultimately stop him as he tried to swerve. According to TMz, cops ran a field sobriety test and asked Justin to take a breathalyzer test, but he refused.

Some of his friends arrived on the scene and attempted to persuade the cops to let him go, but they refused. Justin was handcuffed and arrested, and we’re told it was all captured on body cameras.

Justin Timberlake was released from police detention shortly after making his court appearance. His next court date is set on July 26.

In New York, being convicted of breaching the rules against driving under the influence of alcohol and drugs, or DWI, can result in a suspended or revoked driver’s license, monetary fines, and even a potential jail sentence.
